Apus Apus – Terms of Use & Privacy Policy

Apus Apus (the "App") is developed and published by Ref Yazılım ve Bilişim Teknolojileri Tic. Ltd. Şti. ("Ref Software and Tech", "we", "us", "our"). These Terms of Use and this Privacy Policy (together, the "Terms") govern your use of the App.
By downloading, installing or using the App you agree to be bound by these Terms. If you do not agree, you must not use the App.
1. Terms of Use
1.1. Eligibility
You must be legally capable of entering into a binding agreement under the laws of your country of residence to use the App. If you are under the age at which you can give consent on your own, you may only use the App with the permission and supervision of a parent or guardian.
1.2. Licence to use the App
We grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices that you own or control, solely for your personal, non-commercial use and strictly in accordance with these Terms and any applicable App Store rules.
1.3. Nature of the App
The App offers an ambient and educational experience themed around swifts and nature sounds. It is provided for general information, entertainment and relaxation only. The App is not a medical, health or therapeutic product and does not provide professional advice of any kind.
1.4. In-app purchases and pricing
The App may offer paid features or one-off unlocks as in-app purchases. Prices and availability are shown in the App Store listing for your region and may change from time to time.
Purchases are processed by the platform provider (such as Apple) and are subject to their terms and refund policies. We do not process payment card details ourselves. For information about refunds or billing issues, please refer to the App Store or platform where you made the purchase.
1.5. Prohibited use
You must not:
- reverse engineer, decompile or attempt to extract the App's source code, except where this is allowed by law;
- circumvent or attempt to circumvent any technical protection or usage limits in the App;
- use the App for any unlawful, harmful, abusive or infringing purpose;
- interfere with or disrupt the App or any services or networks connected to it; or
- use the App in a way that could damage, disable, overburden or impair our systems or the experience of other users.
1.6. Intellectual property
All rights, title and interest in and to the App (including all software, designs, artwork, audio, animations, logos and trademarks) are owned by us or our licensors and are protected by copyright and other intellectual property laws. Except for the limited licence in section 1.2, these Terms do not grant you any rights to our intellectual property.
1.7. Availability, changes and updates
We may update, modify, suspend or discontinue the App (in whole or in part) at any time, for example to improve features, fix bugs, adapt to platform changes or address security issues. Where reasonably possible, we will try not to materially degrade the overall user experience.
1.8. Disclaimer and limitation of liability
The App is provided "as is" and "as available" without any warranty of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy or availability.
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special or punitive damages, or any loss of profits, revenues, data or goodwill, arising from or in connection with your use of the App. Our aggregate liability to you for any claim relating to the App or these Terms shall be limited to the amount you have paid (if any) for the App and in-app purchases in the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.
1.9. Changes to these Terms
We may change these Terms from time to time, for example to reflect new features, legal requirements or best practice. If we make material changes, we will take appropriate steps to inform you (for example via an in-app notice or App Store update text). Your continued use of the App after changes take effect will mean you accept the updated Terms.

2.2. Information we do not collect
The App is designed to be simple and privacy-friendly. As of the date above, the App does not require you to create an account or provide your name, email address or similar contact details in order to use the core functionality.
2.3. Information we may collect
Depending on your device settings and platform, we may process the following categories of information when you use the App:
- Device and usage information – such as device model, operating system version, language, time zone, app version and general information about how often you open the App and which screens or features are used.
- Purchase information – information about in-app purchases you make (for example, which product was purchased, the date and time of purchase and the status of the purchase). Payment processing itself is handled by the platform provider (such as Apple); we do not receive your full payment card details.
2.4. How we use information
We use the information described above to:
- operate, maintain and improve the App and its features;
- understand how the App is used so we can refine the experience;
- verify and manage in-app purchases and entitlements; and
- detect, prevent or address technical issues or misuse.
2.5. Legal bases for processing (where applicable)
Where data protection laws (such as the EU/UK GDPR) apply, we process personal data on the following legal bases:
- Performance of a contract – to provide you with the App and any purchases you have made.

The App may use platform services and development tools provided by Apple, Google Firebase and other vendors (for example, for in-app purchases or crash reporting). Those providers may process limited data as independent controllers in accordance with their own privacy policies.

We keep personal data only for as long as necessary for the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. When we no longer need data, we will delete it or anonymise it.

We may update this Privacy Policy from time to time. Any changes will be reflected in the "Last updated" date at the top of this page. If we make material changes, we will take appropriate steps to notify you, for example via an in-app notice.
